Legislative Updates: 114th Congress
Rep Deutch introduces bill to Protect against Patent TrollsToday, Congressman Ted Deutch (FL-21) joined Congressman Jared Polis (CO-2) to introduce the Demand Letter Transparency Act. This legislation will increase the disclosure and information in a demand letter written for alleged patent infringement. Increased information regarding claims of patent infringement will give smaller companies the opportunity to fight against patent assertion entities, otherwise known as “patent trolls.” “Intimidating small businesses, entrepreneurs, and nonprofits with vague demand letters has become one of the most common ways that patent trolls take advantage of the lack of transparency in our patent system,” said Congressman Ted Deutch. This bill will solve a growing problem by tracking demand letters and requiring them to be more detailed, giving businesses the proper tools to defend themselves against claims from patent assertion entities and avoid costly litigation.
